歡迎您使用 SpaceShare 平台（以下簡稱「本平台」）。為保障會員的權益並明確本平台的責任，SpaceShare Limited.（以下簡稱「本公司」）特制定以下使用條款與隱私政策，請仔細閱讀。
一、會員資格與義務
1.1 會員資格
本平台提供多級會員訂閱方案（如 Standard、Premium、Pro），每一級會員可享不同的權益和服務。具體會員級別的權益及服務範圍以本平台當時最新公告為準，會員應自行查閱平台上公佈的方案內容。本平台保留隨時修改會員分級與服務內容的權利，並將變更公告於平台。
本平台的最低年齡限制為15歲。15歲至未滿20歲的使用者需持有有效身份證明文件，並由法定代理人閱讀並同意本使用條款後方可使用，但不得使用交易及訂閱服務。年滿20歲的會員則需持有有效身份證明文件及信用卡，方可註冊並使用本平台的所有服務功能。
基於前述限制，所有付費型訂閱服務（包含 AI Agent 週訂閱）亦僅對年滿20歲並完成信用卡綁定之會員開放，15歲至未滿20歲的使用者不得使用此等付費服務。
會員應為帳戶的唯一持有者，不得將帳戶共用或轉讓他人。如發現帳戶共用或不符合使用資格，平台有權刪除該帳戶且不負任何賠償責任。
1.2 會員義務
會員應提供完整、真實及最新的個人資料，並於資料變更時自行及時更新。如發現會員提供虛假、不完整或過期資料，本公司有權終止該會員的帳戶及服務權利。
會員應妥善保管其帳號及密碼，並避免將其分享給他人。如因會員疏忽導致帳號遭他人使用，會員應自行承擔相關責任及損失。
會員須遵守本平台規範及交易規定，不得從事以下行為：
提供虛假或非法的個人資料；
使用偽冒或非法取得的信用卡號進行交易；
意圖入侵、破壞或干擾平台的正常運作；
違反當地法律或本平台的規定；
出借身份證件給他人申請帳號。
利用本平台提供之 AI Agent 服務從事詐騙、散佈違法內容、侵害他人名譽或權益，以及其他違反公序良俗之行為。
二、會員權益與個人資料保護
2.1 個人資料的收集與使用
本平台在會員註冊、使用服務、訂閱方案或參與活動時，可能會收集會員的個人資料，包括但不限於身份證資料、姓名、地址、電話號碼及信用卡資料等。這些資料將用於身份驗證、支付處理、租賃合同執行及服務支援。
2.2 資料保護機制
本平台承諾依據《個人資料保護法》妥善保護會員的個人資料，並採用行業標準的資料加密技術，包括 TLS 1.3 加密協定和 256 位元 AES 資料加密技術，確保會員個人資料在網路傳輸中的安全性。
2.3 個人資料的使用目的
會員的個人資料將被用於提供本平台的相關服務，包括但不限於：
租賃合同的完成與管理；
交易的確認與通知；
平台的技術支援和售後服務。
AI Agent 互動功能之提供與優化：會員瞭解並同意，在使用 AI Agent 功能時，其輸入的訊息、問題、對話內容等可能會被本平台或合作之技術服務提供商暫時儲存、分析，以回應會員需求並提升服務品質。
在未經會員同意的情況下，本公司不會將會員的個人資料洩露給第三方，除非基於法律要求或本條款另有規定。
2.4 會員的個人資料權利
會員有權依法向本公司請求：
查詢或閱覽其個人資料；
製給複製本；
補充或更正資料；
停止蒐集、處理或利用其個人資料；
刪除其個人資料。
三、賬戶與密碼保護
3.1 賬戶保護
會員應妥善保管其帳號及密碼，並負責因疏忽導致帳號遭他人使用所產生的一切損失與責任。本平台不承擔因會員未能妥善保管帳號及密碼而造成的損失責任。
3.2 賬戶被盜用或誤用
如會員發現其帳號或密碼被盜用或有其他安全風險，應立即通知本公司。本公司將採取合理措施協助會員保護帳戶安全，會員須自行承擔因帳號被盜用導致的損失。
四、訂單金流與支付方式
4.1 訂閱制方案
會員可選擇不同的訂閱制方案（如：Standard、Premium、Pro），每月享有相應權益。
訂閱制方案提供「自動續訂」服務，除非會員提前申請取消，否則系統將自動續訂並扣款。
4.2 訂閱方案的變更與終止
會員可以選擇升級訂閱方案，但同類型的訂閱方案合約期內不得重疊。
若會員欲提前終止合約，需依照本公司流程辦理，並支付作業費 500元。
4.3 訂閱方案支付方式
會員可選擇信用卡、帳戶餘額或其他本公司指定的電子支付方式進行付款。會員應確保其支付資料的真實性及有效性，並承擔因支付資料不正確而導致的損失。
4.4 平台交易收費方式
本平台不向下訂者收取手續費，僅對空間銷售者收取平台服務費。平台服務費比例將根據平台公告進行設定，如有調整，平台將於調整前七日公告。
4.5 訂單結算流程
使用者下訂後，本公司將向下訂者收取訂單全額。每筆預訂完成後，本公司於月底結算已交付之訂單，並於次月15日匯款至空間銷售者指定的銀行帳戶。若因不可抗力因素（如金融機構系統故障）導致匯款延誤，本公司不承擔任何法律責任。
4.6 帳戶正確性
空間銷售者須自行確認於平台指定的帳戶之正確性。若因銀行帳號輸入錯誤或帳戶異常而導致無法匯款，本公司及本平台不負任何法律責任。
4.7 電子發票開立（僅限中華民國地區）
本平台依中華民國法律開立電子發票，發票開立後將寄送至使用者於本平台註冊時所填寫的電子郵件信箱。使用者需確認所提供的信箱為正確且有效，若因信箱錯誤導致的遺漏或其他問題，本平台不負責任。
發票資料正確性：使用載具號碼或統一編號開立發票者，需確認所提供資訊正確。本平台不承擔因載具號碼或統一編號輸入錯誤所產生的責任，且發票一經開立後即不得更改或撤銷。
發票開立對象與金額：本平台對下訂者開立其下訂金額之電子發票，對空間銷售者僅就平台服務費部分開立發票。
4.8 AI Agent 週訂閱服務
服務內容：
AI Agent 服務為本平台提供之智慧化查詢與回覆功能，能協助會員快速搜尋空間資訊、回答使用疑問，並提供其他進階互動功能。
會員瞭解並同意，AI Agent 所提供之所有建議與資訊，僅供參考之用，並不具任何法律、財務、醫療或其他專業建議效力。本公司不為 AI Agent 之任何回答結果負擔保責任或法律責任。
收費與適用會員等級：
Pro 會員：可免費使用 AI Agent 服務，無需另行付費。
Standard 與 Premium 會員：需透過每週訂閱方式方可使用 AI Agent 服務，並於同意訂閱後始能啟用該功能。
每週訂閱費用標準以本平台公告或訂閱頁面顯示為準，本公司保留隨時調整之權利。
每週自動扣款與付款方式：
會員一旦啟用 AI Agent 週訂閱，即表示同意本平台或本平台合作之第三方金流服務提供商，依照會員所綁定之信用卡 / 金融卡 / 電子支付帳戶，每週自動扣取訂閱費用。
為提供更便利的付款體驗，會員同意本平台向金流服務提供商申請「token」以綁定其信用卡或支付帳戶資訊；本平台並不留存會員的完整信用卡資料。
若會員之付款方式無法成功扣款（例如信用卡已逾期、額度不足），本平台將有權暫停該會員的 AI Agent 服務，直至會員更新有效的支付資訊。
取消與退款：
會員可隨時於平台後台或訂閱管理頁面申請取消 AI Agent 週訂閱，取消後將於下一週扣款日前生效，且會員於當週已支付費用不予退還。
會員若需刪除已綁定的信用卡 / token 資訊，可向本平台提出申請。本平台將依金流服務提供商的流程協助處理，惟刪除 token 後，AI Agent 服務亦將同步終止。
責任限制與免責聲明：
本平台盡力維持 AI Agent 服務之正常運作，但不保證其時效性、正確性或適用性。會員應審慎評估並自負使用風險。
若 AI Agent 因系統維護、故障、不可抗力或其他原因而發生暫停或功能異常，本平台不負任何賠償或補償責任。
本平台有權基於維護服務品質、法令遵循或會員違反本條款之情形，隨時暫停或終止會員對 AI Agent 之使用權。
五、訂單取消與退款政策
5.1 下訂者取消訂單
下訂者如需取消訂單，請於空間交付時間（即預訂開始時間）前72小時內提出取消申請，方可全額退款。72小時內申請取消者需提供重大傷病或空間未交付之證明，由本平台審核後決定退款比例。若無即時取消申請或證明無效，本平台不承擔任何法律責任。
5.2 空間銷售者的交付義務
空間銷售者應於訂單開始時間72小時前通知平台任何不可抗力因素所導致的交付延遲或無法交付情況，並提供相關證明文件。本平台將依據證明內容進行審核，並保有最終解釋權。如銷售者未提供證明或證明無效，本平台不承擔任何法律責任。
5.3 解釋權
本平台保留條款最終解釋權。
六、禁止私下交易行為
6.1 私下交易限制
本平台嚴禁任何形式的私下交易行為，使用者不得通過平台以外的途徑與其他會員進行交易。如經查證參與私下交易行為，本平台有權刪除相關帳號，並不負任何賠償責任或通知義務。
七、智慧財產權與違反行為
7.1 智慧財產權
本平台中所包含的所有內容，包括但不限於文字、圖片、影片、聲音、軟體等，均受智慧財產權相關法律保護。會員不得未經授權修改、重製、公開傳輸或散布本平台內容，違者將依法處理。
7.2 違反智慧財產權的處理
若會員違反智慧財產權或其他法律，本公司有權終止其會員資格並依法追究其法律責任。
八、平台性質及責任限制
8.1 平台定位
本平台作為一個共享空間交易中介平台，僅提供使用者與提供者之間的資訊發布、搜尋、預約及訂單處理服務。本平台不參與具體交易，亦不對空間的品質、安全性或合法性作任何形式的擔保。
8.2 責任限制
本公司對於會員因使用本平台服務（包含 AI Agent 提供之回覆或建議）所遭受的任何直接或間接損害，包括但不限於資料丟失、系統故障或利潤損失，不負任何責任。
會員應審慎判斷並自負風險，如有需要，應另尋專業人士之協助。
九、條款修改與法律適用
9.1 條款修改
本公司保留隨時修改本條款的權利。修改後的條款一經發布即生效，會員應定期查閱最新版本條款。
9.2 法律適用與管轄法院
本條款將依據會員所在地的當地法律進行解釋與適用。若發生任何爭議，雙方應本著誠信原則進行協商解決。協商不成的，雙方同意提交至會員所在地的有管轄權的法院解決。
若會員所在國或地區有消費者保護相關法律或規範，則以當地的相關法律為優先適用法律。
會員如不同意修改後的條款，應立即停止使用本平台服務。
十、電子版租賃契約生成與簽署
10.1 電子版租賃契約生成
本公司提供電子版租賃契約的自動生成與簽署服務，當會員使用此服務生成合約時，應仔細閱讀契約內容，並確保完全理解合同條款及其法律效力。
會員應在簽署合約之前仔細審閱所有條款。如有任何疑問，應在簽署前立即提出。一旦合同簽署完成，會員即視為已完全理解並同意合同內容。
10.2 法律責任限免
本公司僅提供電子合約的生成與簽署技術服務，不對合約內容的合法性或有效性負責。會員與提供者之間的合同內容、條款解釋及法律責任應由雙方自行承擔。
本公司對於由於會員未詳細閱讀或理解合約內容而導致的任何損失或法律糾紛不承擔責任。
10.3 簽名檔的收集與保護
在電子合約生成及簽署過程中，本公司將收集會員的電子簽名檔以供合約簽署之用。會員的電子簽名檔將僅用於合同的簽署，不得另作他用。
本公司將採取嚴格的數據保護措施，包括但不限於加密技術、存取限制等，以確保會員簽名檔的安全。除非基於法律要求，會員的簽名檔不會被洩露給第三方。
會員有權隨時要求查閱其電子簽名檔的使用情況，並依照相關法律規定享有對個人資料的保護權利。
十一、責任歸屬
11.1 會員責任
會員在使用本平台的過程中，如有違反本平台規範的行為，應承擔法律責任。本公司將積極配合相關主管機關的調查，並保留對會員違規行為進行法律追訴的權利。會員應賠償本公司因此而產生的各種損失及費用。
11.2 平台責任
本公司系統運作可能因電信業者、信用卡收單業者提供之網路系統故障，或因天災等不可抗力因素而中斷或發生錯誤，本公司不負責因此產生的損失。
本公司對於會員因下載本平台資料或圖片導致設備損壞，亦不負賠償責任。

為了改善您在本平台的使用體驗，SpaceShare 平台（以下簡稱「本平台」）使用 Cookies 來管理網頁操作並提供更佳的個人化服務。本平台將嚴格保護您的隱私，若欲瞭解更多資訊，請參考本隱私政策。

Terms of Use and Privacy Policy
Welcome to the SpaceShare platform (“this platform”). To protect the rights of our members and clarify the responsibilities of this platform, SpaceShare Limited (hereinafter referred to as “the Company”) has established the following terms of use and privacy policy. Please read them carefully.
I. Membership Qualifications and Obligations
1.1 Membership Qualifications
- This platform offers tiered membership subscription plans (such as Standard, Premium, Pro), with each level granting different rights and services. The specific rights and scope of services for each membership level are subject to the latest announcements on this platform, and members are encouraged to review the details. The platform reserves the right to modify membership tiers and services at any time, with changes posted on the platform.
- The minimum age to use this platform is 15. Users aged 15 to under 20 must hold valid identification and have a legal guardian read and consent to these terms before joining; however, they are restricted from using transaction and subscription services. Accordingly, all paid subscription services (including any AI Agent weekly subscription) are only available to members who are at least 20 years old and have completed the required credit card binding process. Members aged 20 and above must hold valid identification and a credit card to register and access all platform services.
- Members must be the sole holders of their accounts and are prohibited from sharing or transferring their accounts. If account sharing or any ineligible membership is detected, the platform reserves the right to delete the account without any compensation liability.
1.2 Member Obligations
- Members must provide complete, accurate, and up-to-date personal information and promptly update any changes. The Company reserves the right to terminate the account of any member providing false, incomplete, or outdated information.
- Members are responsible for safeguarding their account and password. In case of negligence resulting in unauthorized use of their account, members bear full responsibility for all associated losses or damages.
- Members must comply with the platform’s regulations and trading policies and are prohibited from:
- Providing false or illegal personal information;
- Using counterfeit or illegally obtained credit card numbers for transactions;
- Attempting to invade, disrupt, or interfere with the normal operations of the platform;
- Violating local laws or the platform’s policies;
- Lending identification documents to others for account registration.
- Using the AI Agent service for any fraudulent, illegal, or rights-infringing purposes, including but not limited to disseminating unlawful content or defaming others.
II. Membership Rights and Personal Data Protection
2.1 Collection and Use of Personal Data
- This platform may collect personal data, including but not limited to identification information, name, address, phone number, and credit card details during membership registration, service usage, subscription plans, or participation in activities. These details are used for identity verification, payment processing, contract execution, and service support.
2.2 Data Protection Mechanism
- The platform is committed to protecting members’ personal data under the Personal Data Protection Act and employs industry-standard encryption technologies, including TLS 1.3 and 256-bit AES encryption, to ensure data safety during transmission over the internet.
2.3 Purpose of Data Usage
- Members’ personal data will be used to provide relevant services, including but not limited to:
- Completion and management of rental contracts;
- Transaction confirmation and notifications;
- Technical support and after-sales services.
- Provision and optimization of AI Agent functionality: By using the AI Agent service, you acknowledge and agree that any input, questions, or conversation logs may be temporarily stored or processed by this platform or its third-party technical service providers, in order to respond to your inquiries and improve service quality.
- The Company will not disclose members’ personal data to third parties without consent, except as required by law or as specified in these terms.
2.4 Member Rights Regarding Personal Data
- Members have the right to:
- Access or view their personal data;
- Request a copy of their personal data;
- Supplement or correct their data;
- Stop the collection, processing, or use of their personal data;
- Delete their personal data.
III. Account and Password Protection
3.1 Account Protection
- Members must safeguard their account and password and will bear all losses and liabilities arising from unauthorized account use due to their negligence. The platform is not responsible for losses caused by members’ failure to protect their account and password.
3.2 Account Misuse or Unauthorized Use
- If a member suspects that their account or password has been misused or faces any security risks, they should immediately notify the Company. The Company will take reasonable measures to assist in securing the account, but members are liable for any losses due to unauthorized account use.
IV. Order Payments and Transactions
4.1 Subscription-Based Plans
- Members may choose from various subscription plans (such as Standard, Premium, Pro), with monthly benefits according to the chosen plan.
- Subscription plans feature “auto-renewal” services. Unless canceled in advance, the subscription will automatically renew, and payment will be charged accordingly.
4.2 Plan Changes and Termination
- Members may choose to upgrade their subscription plans; however, overlapping contracts of the same type within the contract period are not permitted.
- Members who wish to terminate their contracts early must follow the Company’s procedures and pay an administrative fee of NT$500.
4.3 Payment Methods for Subscription Plans
- Members may pay using a credit card, account balance, or other electronic payment methods designated by the Company. Members are responsible for the accuracy and validity of their payment details and will bear losses caused by incorrect payment information.
4.4 Platform Transaction Fees
- This platform charges no fees to the booker but applies a service fee to space providers. Service fee rates will be determined based on each order and announced on the platform seven days prior to any adjustments.
4.5 Order Settlement Process
- After booking, the Company will charge the full order amount from the booker. After completing each order, the Company will settle transactions for the month’s completed bookings and remit payments to the space provider’s designated account on the 15th of the following month. The Company assumes no liability for payment delays due to force majeure, such as system outages by financial institutions.
4.6 Account Accuracy
- Space providers are responsible for verifying the accuracy of their designated account information. The Company and platform assume no responsibility for issues caused by incorrect account numbers or account irregularities that prevent remittance.
4.7 Electronic Invoices (Limited to the Republic of China)
- The platform issues electronic invoices per Republic of China law and sends them to the email address provided by the user upon registration. The user must ensure the accuracy and validity of their email address, as the platform assumes no responsibility for any omissions or issues caused by incorrect email information.
- Invoice Data Accuracy: Users opting for invoice issuance with carrier numbers or tax IDs are responsible for verifying the accuracy of this information. The platform assumes no responsibility for errors due to incorrect data, and invoices cannot be amended once issued.
- Invoice Issuance Amount: The platform issues invoices for the full booking amount to the booker and only issues invoices for service fees to space providers.
4.8 AI Agent Weekly Subscription Service
Service Content:
The AI Agent is an intelligent query and response feature provided by this platform. It assists members in quickly searching for space information, answering questions, and offering other advanced interactive functions. You acknowledge and agree that any suggestions or information provided by the AI Agent are for reference only and do not constitute legal, financial, medical, or any other professional advice. The Company does not bear liability for any outcomes or decisions based on AI Agent responses.
Fees and Applicable Membership Plans:
Pro Members: May use the AI Agent service at no additional cost.
Standard and Premium Members: Must subscribe on a weekly basis to enable the AI Agent service. The subscription will take effect once the member consents to the subscription plan.
The weekly subscription fee is subject to the rate published on this platform or on the subscription page. The Company reserves the right to adjust the fees at any time.
Weekly Auto-Charge and Payment Method:
By activating the AI Agent weekly subscription, you authorize the platform or its designated third-party payment provider to automatically charge the specified credit card, debit card, or e-payment account each week for the subscription fee.
To enhance user convenience, you agree that the platform may request a “token” from the payment provider to bind your credit card or payment account information. The platform does not retain your full credit card details.
If the payment method you provided fails (e.g., expired credit card, insufficient funds), the platform may suspend your AI Agent service until valid payment information is provided.
Cancellation and Refunds:
You may cancel the AI Agent weekly subscription at any time via your account dashboard or subscription management page. Once canceled, the service will end before the next weekly billing date. No refunds will be issued for the current week’s subscription fee already paid.
If you wish to delete your bound credit card / token information, you must submit a request to the platform. The platform will coordinate with the payment provider to remove the token. Please note that removing the token will also terminate your AI Agent service.
Limitation of Liability and Disclaimers:
The platform endeavors to maintain normal operation of the AI Agent service but does not guarantee its timeliness, accuracy, or suitability. Members should exercise due caution and assume all risks when using the service.
The platform shall not be liable for any interruptions or functional errors of the AI Agent resulting from system maintenance, malfunction, force majeure, or other reasons.
The platform reserves the right to suspend or terminate a member’s use of the AI Agent at any time for reasons including, but not limited to, service quality maintenance, legal compliance, or member violations of these terms.
V. Order Cancellation and Refund Policy
5.1 Booker Order Cancellation
- If a booker wishes to cancel, they must do so at least 72 hours before the space handover time (the booking start time) for a full refund. For cancellations within 72 hours, the booker must provide proof (e.g., severe illness, non-performance of the space handover), and the platform will review and determine the refund amount. The platform assumes no responsibility for failure to cancel promptly or if no valid proof is provided.
5.2 Space Provider Delivery Obligations
- Space providers should inform the platform at least 72 hours before the scheduled booking time if they cannot deliver due to force majeure and provide relevant proof. The platform will review the proof and reserves the final right of interpretation. If no valid proof is provided or if it is deemed invalid, the platform assumes no legal responsibility.
5.3 Right of Interpretation
- The platform reserves the final right of interpretation for these terms.
VI. Prohibition of Off-Platform Transactions
6.1 Off-Platform Transaction Restriction
- The platform strictly prohibits any form of off-platform transactions. Users are not allowed to engage in transactions with other members outside the platform.
